Judge Brenda Penny denied a request by the singer’s lawyer Mathew Rosengart to immediately lift the conservatorship. The court also denied Mr Rosengart’s request to move forward the planned September 29 hearing to this month.Britney’s legal team had requested Jamie’s immediate removal, claiming the more time Jamie was causing “avoidable harm”. “Ms Spears’s emotional health and wellbeing must be, and are, the paramount concern,” Britney’s defence claimed.“Further, all interested parties forcefully agree that Mr. Spears’s continued presence as Conservator of the Estate is contrary to Ms Spears’s best interests, health, and wellbeing, and that his prompt removal — or, at the very least, his immediate suspension — is ‘critical’ at this juncture.”After the plea was denied, Britney, 39, took to Instagram to declare she felt “completely hopeless”.“In a system where I’ve felt completely hopeless for so long, at least I do have a platform to share. The world can be a nasty place … I know it … you know it … kill them with kindness,” Spears said, before blasting “mean lies” about her. “Unfortunately the news has been pretty nasty saying horrible and mean lies about me so I’m gonna post a little less from now on. TA TA.”‘DISTRAUGHT’Britney Spears’ conservator feared for the singer’s mental health just last month, according to her father Jamie Spears. In new court documents, Mr Spears alleged that Jodi Montgomery frantically called him on July 9 to communicate her alleged fears about the pop star’s mental health.“Mr Spears received a call from Ms Montgomery on July 9, 2021, in which she sounded very distraught, expressed concern about Ms Spears’ recent behaviour and her refusal to listen to or even see her doctors,” lawyers for Jamie Spears claimed in the filing obtained by Fox News.Mr Spears alleges that Ms Montgomery “pleaded for Mr Spears’ help to address these issues”.Mr Spears’ filing goes on to state that his “sole motivation has been his unconditional love for his daughter and a fierce desire to protect her from those trying to take advantage of her.”The filing alleges that Mr Spears believes his daughter’s alleged medical treatment is “indeed serious.”Friday’s filing comes just one day after Spears’ new lawyer, Mathew Rosengart, filed an ex parte application, requesting that the upcoming September 29 hearing in her conservatorship case be moved to September 29.‘IT ONLY DOES HARM’Britney Spears’ personal conservator hit out at the star’s dad’s claims that she wanted to put the singer in a psychiatric hold.Conservator Jodi Montgomery has demanded that Mr Spears “stop the attacks” after he made a litany of new allegations about his famous daughter’s mental wellbeing in court documents filed in the US on Friday.“Ms Montgomery is saddened that her telephone call to Mr Spears, made out of genuine concern for Ms Spears, and intended to re-establish a working relationship with Mr Spears towards Ms Spears’ mental health and wellbeing, is now being misrepresented and manipulated to gain some sort of tactical advantage in the pending proceedings to remove him as Conservator,” reads the statement as reported by People magazine. “Ms Montgomery implores Mr Spears to stop the attacks – it does no good; it only does harm.” “We all need to focus on one thing, and one thing only – the health, wellbeing and best interests of Britney Spears,” the statement continued.Ms Montgomery also stated that the best outcome for Britney is that her father relinquishes his role as her conservator and goes “back to just being Ms Spears’ father, and working on a healthy, supportive father-daughter relationship”.Ms Montgomery’s statement comes after Mr Spears opposed his daughter’s request for his role as conservator to be “immediately” suspended. (Britney’s lawyer claimed that keeping Jamie as conservator has caused her to “continue to feel traumatised, lose sleep and suffer.”)In court documents filed on Friday, Mr Spears claimed Britney is so “mentally sick” that Ms Montgomery considered putting her under a psychiatric hold.In the filing, Mr Spears alleged that conservator Ms Montgomery rang him in July sounding “very distraught” over his daughter’s mental health.“Mr Spears received a call from Ms Montgomery on July 9, 2021, in which she sounded very distraught, expressed concern about Ms Spears’ recent behaviour and her refusal to listen to or even see her doctors,” lawyers for Mr Spears claimed in the filing, which was obtained by Fox News.In the documents, Mr Spears alleged that Ms Montgomery “pleaded for Mr Spears’ help to address these issues”.According to Mr Spears, Ms Montgomery told him the singer wasn’t “timely or properly taking her medications, was not listening to the recommendations of her medical team”.Britney also allegedly “refused to even see some of her doctors”.Lawyers for both the pop star and Ms Montgomery have not made any comment on the allegations.Mr Spears’ filing states that his “sole motivation has been his unconditional love for his daughter and a fierce desire to protect her from those trying to take advantage of her”.The filing alleges that Mr Spears believes his daughter’s alleged medical treatment is “indeed serious”.He additionally claimed that it was Ms Montgomery and his daughter’s former lawyer, Samuel Ingham III, who “admitted Ms Spears to a facility in early 2019, including but not limited to signing the admittance documents”.The documents also alleged that Mr Spears has requested $US1.4 million ($A1.9 million) from just the course of the past several months to cover his legal fees. The filing comes just one day after Britney’s new lawyer, Mathew Rosengart, filed an ex parte application, requesting that the upcoming September 29 hearing in her conservatorship case be moved to later this month.“Conservatee Britney Jean Spears will and hereby does apply to the Court, on an ex parte basis, for an Order Advancing the September 29 Hearing Date on Conservatee’s Petition to Remove James Spears as Conservator of the Estate and Petition to Appoint Jason Rubin as Conservator of the Estate. In the alternative, Conservatee moves for the immediate suspension of James P. Spears as Conservator and the appointment of Jason Rubin as Temporary Conservator pending the hearing presently set for September 29, 2021,” the court filing states, according to Fox News.In response, Mr Spears’ lawyers claim there are “no grounds whatsoever to suspend” him as conservator of the estate. And while Mr Spears claims he will “not object” to the hearing being moved to an earlier date, he said Mr Rosengart’s request included “unsubstantiated, vague accusations and a false statement about Mr Spears opposing a trip to Hawaii”. In his filing, Mr Rosengart cited the singer’s testimony from the June 23 and July 14 hearings, declarations from Ms Montgomery and Lynne Spears as “good cause” for the application.“Conversely, every day that passes is another day of avoidable harm and prejudice to Ms Spears and the Estate,” the documents continue. “As described in the Verified July 26 Petitions and filings under Probate Code Section 2650, Ms Spears’s emotional health and wellbeing must be, and are, the paramount concern,” Mr Rosengart claimed.Last month, Mr Rosengart was appointed as Britney’s new counsel following bombshell testimony she gave in Los Angeles Superior Court in June. On June 23, the singer addressed Judge Brenda Penny, calling the conservatorship she’s been under for 13 years “abusive” and claimed her father has enjoyed his “control” over her life. She voiced similar concerns in July.Mr Rosengart has asked that Mr Spears be replaced with accountant, Jason Rubin. Mr Rosengart called the move an “objectively intelligent preference to nominate a highly qualified, professional fiduciary in this circumstance.”– with Fox News
