Former Federal Prosecutor Defending J6ers Decries “No Alternative To Trials In DC” – What He’s Doing To Change That

The swamp is going after supporters of Donald Trump.

Former federal prosecutor Bill Shipley, who is defending multiple people arrested over January 6th, decried that there are no alternatives to having trials in Washington D.C.

He pointed out that cases are moved to other districts due to jury pools being affected by bias all the time — but the DC Circuit Court won’t move the cases.

He said, “I hope to be one of many defense attorneys who will be there to argue in the Appeals Court that the DC Circuit needs to bring itself around to the view of the other Circuits in the country on this issue.”

Right now there is no alternative to trials in DC. But at some point in the not-too-distant-future, the DC Circuit Court of Appeals is going to have to come to grips with its decision almost 50 years ago in U.S. v. Haldeman. 9/

It will need to recognize that case fails to take into consideration the modern media age when it comes to how jurors are prejudiced by the distribution of news in the 21st Century. Other Circuit Courts of Appeal of the rest of the country have dealt with this issue. 10/

Cases elsewhere in the country are moved from one district to another because of pretrial publicity causing bias in the juror pool. But the DC Circuit – 50 years ago – told judges to try to pick a jury first. Only if unsuccessful should a case be transferred. 11/

That’s view is outdated, and I hope to be one of many defense attorneys who will be there to argue in the Appeals Court that the DC Circuit needs to bring itself around to the view of the other Circuits in the country on this issue. 12/

He also gave an update on what he’s doing next.

Shipley will be representing Jeffrey McKellop, a decorated Special Forces operator in April and has 5 more trials he is involved in between May and July.

In April I’ll be 1 of 3 new attorneys representing Jeffrey McKellop, a decorated Special Forces operator in custody for almost 2 years. Jeff’s is one of the most difficult Jan 6 cases, but he earned the right to have a vigorous defense from Phil Linder, Lee Bright and myself. 5/

After that I have two trials in May, another in late June, then two in July. This is going to continue right on into the fall. Plus, I now have solid info that the government is preparing a new round of indictments. There will be people facing charges related to Jan 6. 6/

The recent Oath Keeper trial did not produce the result that my client and I hoped for. We believe our response to the Gov’t case was more than sufficient to win him acquittals on all the charges, and I have confidence our post-trial motions and any appeals will be successful. 7/
